Terms of use for images of the IMG image database
By consenting to the terms of use, a legally valid contract for the use of the images from the image database of this website comes into effect between you and Investitions- und Marketinggesellschaft Sachsen-Anhalt mbH (IMG). The images may be downloaded directly from this website.
In case of individual download: By clicking on the button �Save data�, you agree to the terms of this contract. If you do not agree, click on the button �Close window� in order to reject the contract. Then, you will not be granted access to the image data. In case of group download via the shopping cart: By ticking the terms of use, you agree to the terms of the contract. If you do not agree and do not tick the respective box, the download process will not be enabled. Please note that you will not be granted access to the image data in this case.
1.) General provisions
All offers, deliveries, electronic transmissions and the granting of rights of use take place solely in non-exclusive manner subject to the following terms and conditions. Deviating terms and conditions of the user are herewith objected to.

2.) Intended use 
You have to inform IMG about the use of the digital pictures. This takes place by means of entering the purpose of use when downloading the image. Corresponding to such information on the use, IMG will grant you the permission for such use. The permission can be granted exclusively for the private, journalistic use as well as for advertising in connection with the promotion of travel & investments for Saxony-Anhalt. A use by publishing houses specialised in images, book or maps is excluded unless governed by a special agreement.
If your information does not correspond to the actual use of the picture, the permission for use granted shall become void. 
After each publication, IMG shall be sent at least two specimen copies free of charge and without request. If your information does not correspond to the actual use of the picture, the permission for use granted shall become void.
3.) Data provision

The image data may be taken as download of individual images (72 or 300 dpi) or as shopping cart download (300 dpi).
Each 300 dpi download is delivered in a .zip-file and contains the image data, one file with the image texts incl. information on the photographer and the terms of use.
The following uses may be permitted:
A. Printing use
If you are granted an image right for the printing use, you may use the image for printing applications (300 dpi image file) such as for example articles, travel catalogues, brochures, reportages and for teaching purposes. In all cases, 1 specimen copy is requested in which the image owner / photographer is named. The licence for printing use comprises the rights to multimedia use under paragraph B below.
B. Multimedia use
If you use a picture for multimedia use (72 dpi image file), you may incorporate the image exclusively in non-printing applications, such as for example websites, video transmissions, multimedia presentations and CD ROMs. Changes of the images are not allowed. Image owners / photographers must be named in case of each use. Please inform us in writing about the address of the website in each case.
C. Layout use
You may incorporate the layout image file in a layout exclusively for presentations for the purpose of acceptances/releases or for planning purposes.
4.) Copyright

All images are protected by copyright. IMG and its licensors possess the required rights in the images. Only the rights that are required in order to implement the intended use approved shall be transferred to you.

IMG grants to you a simple, non-transferable right of use. Non-transferable within the meaning of the present paragraph means that the image either has to be intended for your own use or for your direct employer, direct principal or direct customer who is the end user of the image. In addition, you may not sell, lease, let, sub-licence or otherwise transfer the image or the right to use the image to anybody.

The copyright note for publishing is as follows: "Image owner/ photographer". Only the display titles specified in the database may be used as captions. Any change requires the consent of IMG. The user is obliged to provide the information required for any publication of the picture. If IMG does not receive specimen copies within 2 months after ordering the images, we reserve the right to block your access data.
5.) Duration of use; deletion

The data are made available for a limited period of time. All data have to be deleted again in each case 12 months after the completed digital transfer of the data. If the respective data are needed for more than 12 months, the digital archiving of these data in excess of the period shall require the written consent of IMG. After the archiving period agreed here or otherwise in writing expires and after use of the data, such data are to be destroyed or to be returned to IMG, including printouts on paper, slide film or negative film or any other data storage media.

Any unauthorised storage or archiving constitutes a violation of the rights of use and may be prosecuted under criminal and civil law.
6.) Fee

Both the download of individual images as well as the shopping cart download is free of charge for the types of use mentioned under number 2) on principle. If you wish to use the images for commercial purposes (e.g. for publishing houses specialised in images, books or maps), please contact IMG. 
7.) Prohibition of use of the images in connection with sensitive topics

It is expressly not allowed to use our images for the following purposes and/or in the following contexts:
a.	For the indirect or direct establishment and/or promotion of an association with products, natural or legal persons who have not expressly consented to such use.
b.	In order to defame or degrade products, natural or legal persons.
c.	In connection with a possibly sensitive topic including, without limitation, sex, contraception, abuse, domestic violence, physical or mental disabilities, illnesses, cancer, aids, drug abuse, alcohol, cigarettes and the like.
d.	For pornographic purposes.
e.	In connection with a negative depiction of Saxony-Anhalt, the places in the federal state and in connection with all relevant topics relating to the federal state of Saxony-Anhalt.
8.) Indemnification of third party claims

IMG is to be indemnified from any claims of third parties resulting from any use of an image which is not part of the applications expressly permitted by this agreement.
9.) Liability

The liability of IMG is limited to intention and gross negligence. IMG does not accept any liability for the usability/merchantability/marketability of the images for a certain purpose.
10.) Changes of the images

The images downloaded/procured may be changed or alienated only after written approval and consultation with IMG.
11.) Data processing and data protection
1.	IMG stores personal data of the customer obtained within the framework of the performance of the contract by means of automatic data processing on an image database server of HPM Kommunikation GmbH in Wiesbaden, Germany.
2.	Customer data obtained on the occasion of orders shall be collected, processed and stored by IMG only in the connection of handling the order.
3.	The data shall not be forwarded.
12.) Miscellaneous 

If a provision of the present agreement is ineffective, the validity of the remaining provisions shall not be affected by that. The ineffective provision shall be replaced by such provision which is effective and which is as close as possible to the content and purpose of the ineffective condition as far as legally admissible.
